Introduction
These Terms and Conditions cover the sale of products included on The French Table website. Please read through these Terms and Conditions carefully before using the website and also our privacy notice and cookies notice regarding the collection and uses of your personal information. By placing an order with The French Table you are agreeing to the Terms and Conditions as set out below.

The Terms & Conditions constitute a binding legal agreement between the Store (“us”, “we” or “our”) and you. Please read the Terms & Conditions carefully and if you do not agree to any of them, you will not be entitled or permitted to access or use the Online Ordering System and you must refrain from doing so.

We may change the Terms & Conditions from time to time to the extent permitted by applicable law. We will provide you with notice of any such change through our website, app and/or by other means, as appropriate. You should review the Terms & Conditions periodically and you agree that your continued use of the Online Ordering System after we publish or send a notice about any changes to the Terms & Conditions constitutes your acceptance of the updated Terms & Conditions as of their effective date. If you object to any changes to the Terms & Conditions, you may stop using the Online Ordering System.

Purpose
The purpose of the Online Ordering System is to provide a simple, convenient and cost-effective service that enables you (and other customers) to place orders for the collection of food and/or other items (the “Products”) with us.

Description of Goods
The Company’s Goods are freshly made from high-quality ingredients. Goods will be packed in an outer cardboard box or bag for protection during transit. The photographs on the Website show sample goods only and cannot be relied upon to be an identical representation of the Goods that the Buyer will receive upon delivery or collection.

We will do our best to ensure that all details, descriptions and prices of products appearing on this website are correct at the time when the information was entered onto the system. Although we aim to keep the website as up to date as possible, the information including product descriptions may not always reflect the position exactly at the moment you place an order. We cannot confirm the price of a product until your order is accepted in accordance with our order acceptance policy. All sizes quoted are approximate. The illustrations of colours and covers are representative only. We make every effort to ensure that colours are as close as possible to the actual colours; however there may be slight variations due to the nature of the medium.

Orders
Although the Company will use reasonable endeavours to try and facilitate any changes to an Order if requested, it cannot guarantee that any such changes will be made as all Goods are made fresh to order and may be prepared and boxed ready for collection.

All goods are made to order and by their nature are perishable and have a limited shelf life. Whilst the Company will allow cancellation of Orders it will not have any obligation to refund the purchase monies to the Buyer where the Order has already been made and is available for collection. The Company reserves the right to charge the Buyer a Transaction Charge on Orders cancelled.

Where Goods have been ordered for collection, the Buyer will identity the date and time that they will collect the Goods through a confirmation phone call or email from The French Table and the Goods will be available for collection at The French Table, 1 Steamboat Quay, Limerick V94 RW84 on that date and time.

If the Buyer either fails to collect goods ordered for collection within the hours set out above then the Company will have no obligation to refund the purchase monies paid for the goods.

Voucher sales cannot be used for online purchases. Vouchers can only be redeemed directly at The French Table.

Payment
Your debit or credit card is charged for the amount when the order is created. The sale will be submitted for processing as soon as you click on the “confirm” button. You will then receive confirmation from us to confirm the sale, availability of the product, and expected collection date.
Payments on frenchtable.ie are made through our secure third party payment gateway Stripe. The Stripe payment system uses a combination of both established and innovative techniques to ensure the security and integrity of all sensitive data. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of refusing or by reason of unwinding, or suspending any transaction after processing has begun.

Prices
All prices are in Euro (€), and are payable in Euro (€). All prices listed include VAT (Value Added Tax) at the Republic of Ireland standard rate of 13.5% and 23%. Due to circumstances beyond our control prices may have to be increased or decreased including any alterations to VAT.

Disclaimer and Liability
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.

We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall The French Table, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

Allergens

All of the products listed contain and may contain allergen ingredients such as Gluten, Mustard, Nuts, Sesame Seeds, Eggs, Dairy, Sulphur Dioxide, Fish, Celery, Crustaceans, soya. We work hard to limit the risk of cross-contamination but all the listed products are produced in a bakery that may result in cross-contamination of other listed Allergens: crustaceans, fish, peanuts, celery, mustard, sulphur dioxide and sulphites, lupin, molluscs.

Use of data
If you enter your payment card details on the Online Ordering System, these details will be stored securely by a third party payment service provider. We do not have access to your payment card details, with the exception of the last 4 digits of your payment card number and the card expiry date which are used to identify your card and orders.

Where you provide your mobile phone number, your name, your address, your e-mail address or notes through the Online Ordering System this information will be processed to administer your order.

Third party information; You warrant that third party personal information provided by you to us while placing an order with us has been obtained fairly and lawfully, and that such third parties have been informed of their rights. You also warrant that subjects are aware of the purpose for which their personal data is being used and that such data may be transferred outside of the EEA.

Obligations and Limitations on Use
The Online Ordering System is made available for access by you in our country of establishment and we make no representation or warranty that any information, materials or functionality included in the Online Ordering System is appropriate or available for use in any jurisdiction other than our country of establishment.

You agree that any information provided by you on the Online Ordering System (including your name and contact details) is true, accurate, current and complete in all respects at the time it is provided and that you will update this information when subsequently using the Online Ordering System to the extent that it changes.

By using the Online Ordering System you also agree that:
.1 you will comply with the Terms & Conditions;
.2 you will not impersonate any other person or entity or use a false name or a name that you are not authorised to use on the Online Ordering System;
.3 you are 18 years of age or older;
.4 you will pay for all Products ordered by you through the Online Ordering System;
.5 you will not use the Online Ordering System to place any speculative or false orders;
.6 you will not use the Online Ordering System to research our Products or the pricing of our Products;
.7 you will not use any automated systems, robots or software to extract data from the Online Ordering System.
You acknowledge and agree that you may not use the Online Ordering System for any unlawful purpose, including without limitation:
.8 transmitting material that constitutes a criminal offence, results in civil liability or otherwise breaches any laws, regulations or codes of practice;
.9 interfering with any other persons use or enjoyment of the Online Ordering System;
.10 damaging, disabling or impairing the operation, functionality or availability of the Online Ordering System (including by knowingly or recklessly introducing to the Online Ordering System viruses, trojans, worms, logic bombs or other material which is malicious or harmful) or attempting to gain unauthorised access to the Online Ordering System or to networks connected to it, through hacking, spoofing or any other means;
.11 distributing any unlawful, libellous, abusive, threatening, harmful, obscene or otherwise objectionable material on or through the Online Ordering System.

You may not access the Online Ordering System for any commercial purposes (including for the purposes of copying or reproducing any material on the Online Ordering System, monitoring the availability, performance or functionality of the Online Ordering System, or for any other benchmarking or competitive purposes).

Communication
You consent to us providing you with notices and other communications electronically either through the Online Ordering System or by other electronic means and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing.

Cancellation
You acknowledge and agree that we may cancel an order placed by you on the Online Ordering System, either before or after acceptance of such order, where we believe that inaccurate information was provided as part of this order or where circumstances beyond our reasonable control occur which prevent or hinder completion of such order.

General Terms
If any part of these Terms & Conditions are deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from the Terms of Use and shall not affect the validity and enforceability of any of the remaining provisions of the Terms of Use.

No failure or delay by us to exercise any right or remedy provided hereunder or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy. No single or partial exercise of such right or remedy shall prevent or restrict the further exercise of that or any other right or remedy.

You agree that no partnership, employment, or agency relationship exists between you and us as a result of the Terms of Use or your use of the Online Ordering System.

These Terms & Conditions constitute the entire agreement between you and us regarding the Online Ordering System and supersede and extinguish all prior agreements promises, assurances, warranties, representations and understandings between you and us regarding the Online Ordering System.

You may not assign, novate or otherwise transfer the Terms & Conditions to any person without our prior written consent but you agree that we may assign, novate or otherwise transfer any of our rights or obligations under the Terms of Use to our affiliates or a party that acquires us.

Governing Law
These Terms & Conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the Terms & Conditions or their subject matter shall be governed by, and construed in accordance with, Irish law and any such dispute or claim shall be resolved exclusively in the courts of Ireland or in the courts of the country of our establishment.
